By accessing or using the website at napafencebuilder.com (the "Site") or by engaging Advanced Napa Fence Builder ("we," "us," or "our") for any services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or engage our services.
Advanced Napa Fence Builder provides residential and commercial fence installation, repair, replacement, and related services in Napa, CA and surrounding areas. Services include but are not limited to wood fence installation, vinyl fence installation, chain link, aluminum, ornamental iron, pool fencing, gate installation, and fence staining and sealing.
All services are subject to a written agreement or signed estimate between the customer and Advanced Napa Fence Builder. Descriptions of services on the Site are for informational purposes only and do not constitute an offer or guarantee of specific outcomes.
Estimates provided by Advanced Napa Fence Builder are based on information available at the time of the site visit. Final pricing may change if project conditions differ from what was observed during the estimate - for example, if underground obstructions are discovered, if the scope of work expands at the customer's request, or if material costs change between estimate and installation.
A written estimate is valid for 30 days from the date it is issued unless otherwise noted. We will notify you in writing of any changes to pricing before proceeding with additional work.
Project start dates are scheduled based on our current workload and availability. We will confirm your installation date at the time of contract signing. We reserve the right to reschedule due to weather, material delays, or unforeseen circumstances. We will notify you as promptly as possible if a rescheduling is necessary.
If you need to cancel or reschedule your project, please notify us at least 48 hours in advance. Cancellations made with less than 48 hours notice after a deposit has been paid may result in forfeiture of that deposit, at our discretion, to cover materials already ordered or crew scheduling costs incurred.
Payment terms will be outlined in your written estimate or contract. In general:
Failure to remit payment when due may result in suspension of work, a lien on the property, and collection action. Overdue balances may accrue interest at the maximum rate permitted by California law.
The customer is responsible for verifying property lines and any applicable HOA rules prior to project commencement. Advanced Napa Fence Builder will obtain required building permits on behalf of the customer when included in the project scope. Permit fees will be itemized separately in the estimate.
We will call 811 (California Underground Service Alert) before any digging begins. However, we are not liable for damage to unmarked utilities, irrigation lines, or other underground infrastructure that was not disclosed to us prior to work starting.
We stand behind the quality of our work. Any warranty terms specific to your project will be stated in your written contract. In the absence of a specific written warranty, the following applies:
Except as expressly stated above, services and materials are provided "as is" without any additional warranty, express or implied. We do not warrant that fencing will achieve any particular aesthetic result beyond what is described in the written estimate.
To the fullest extent permitted by applicable law, Advanced Napa Fence Builder shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services or the Site, including but not limited to loss of use, loss of income, or damage to property beyond the direct scope of our work.
Our total liability for any claim arising from a project shall not exceed the amount actually paid by the customer for the specific work giving rise to the claim.
The content on this Site is provided for informational purposes only. You may not copy, reproduce, distribute, or use any content from this Site for commercial purposes without our prior written consent. We reserve the right to modify or discontinue any portion of the Site at any time without notice.
We do not guarantee that the Site will be error-free, uninterrupted, or free from viruses. Use of the Site is at your own risk.
If a dispute arises between you and Advanced Napa Fence Builder, both parties agree to first attempt to resolve it through good-faith communication. Please contact us directly at team@napafencebuilder.com so we have the opportunity to address your concern before any formal action is taken.
If direct resolution is not possible, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, with arbitration to take place in Napa, CA. Nothing in this clause prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
These Terms and Conditions and any disputes arising from them are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any legal proceedings not resolved by arbitration shall be brought in the courts of Napa County, California.
We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with a new effective date. Your continued use of the Site or our services after any changes constitutes your acceptance of the updated terms.
